The following Booking Terms and Conditions (referred to as these "Terms" or "Agreement") apply to all travel and travel-related services offered by Sam Reynolds LLC dba Cafe Namaste, and/or its officers, employees, representatives, affiliates, agents, or subcontractors (hereinafter referred to as "Cafe Namaste," "Owner," "we," or "us").

By booking a tour with Cafe Namaste, you ("Participant" or "you") agree to be bound by these Terms. Please read them carefully. If you have questions, contact us at hello@gocafenamaste.com before booking.

1. SELLER OF TRAVEL REGISTRATION

Sam Reynolds LLC dba Cafe Namaste is registered with the State of Florida as a Seller of Travel.

Registration Number: ST42185

Registration as a Seller of Travel does not constitute approval by the State of Florida.

2. ELIGIBILITY

  • You must be at least 18 years old to book a tour.

  • Tours are available to residents of the United States and international participants.

  • By booking, you confirm that you have the legal authority to enter into this Agreement and to bind any other participants included in your booking.

 

3. DEFINITIONS

"Tour" means any travel package, retreat, or experience offered by Sam Reynolds LLC dba Cafe Namaste.

"Services" include tours, accommodations, ground transportation, activities, yoga and wellness programming, cultural excursions, and any other travel-related products offered as part of a Tour.

"Itinerary" refers to the schedule of activities, accommodations, and services for a specific Tour.

"Third Party Suppliers" or "Vendors" means hotels, airlines, local guides, transportation providers, activity operators, restaurants, and other independent parties engaged to provide components of the Tour.

"Force Majeure" means events beyond reasonable control, including but not limited to: acts of war (declared or undeclared), armed conflict, terrorism, civil unrest, government actions, travel bans, pandemics, epidemics, natural disasters, severe weather, strikes, airline failures, or any circumstance that makes travel impossible, impractical, or unsafe.

"Participant," "you," or "your" refers to any person participating in a Tour or booking a Tour on behalf of themselves or others.

4. RESERVATIONS & DEPOSITS

  • To reserve a space, you must complete the booking process and submit a non-refundable deposit.

  • Deposit amounts vary by Tour and will be specified on the Tour page and in your booking confirmation.

  • All payments must be made in U.S. Dollars (USD).

  • A 3% processing fee applies to credit card payments. Participants are responsible for any bank transfer fees.

  • Your reservation is not confirmed until your deposit is received and you receive written confirmation from Cafe Namaste.

 

5. PAYMENT TERMS

Payment:Due Date

Non-refundable deposit: At booking

Remaining balance: By deadline specified for each Tour

  • If your reservation is made after the balance due date, full payment is required at booking.

  • Participants who have not paid in full by the deadline will not be eligible to join the Tour.

  • If payment is not received by the due date, your booking may be canceled and all cancellation fees will apply.

6. CANCELLATION & REFUND POLICY

ALL PAYMENTS ARE FINAL AND NON-REFUNDABLE. THERE ARE NO EXCEPTIONS.

This includes cancellations due to:

  • Personal reasons or change of plans

  • Illness, injury, or family emergencies

  • Flight cancellations or travel disruptions

  • Visa denial or passport issues

  • Acts of war, terrorism, or civil unrest

  • Pandemics or public health emergencies

  • Natural disasters or severe weather

  • Government travel bans or advisories

  • Insurance claim denials

  • Any other reason, whether within or beyond your control

No refunds will be issued for early departure, no-shows, or unused services.

Partial credits or transfers to future tours are not guaranteed and are offered only at the sole discretion of Cafe Namaste.

We strongly recommend purchasing comprehensive travel insurance, including Cancel For Any Reason (CFAR) coverage where available — see Section 7 below.

7. TRAVEL INSURANCE REQUIREMENT

Travel insurance is mandatory for all participants.

You must purchase comprehensive travel insurance that includes:​

  • Trip interruption coverage

  • Medical evacuation and repatriation (minimum $100,000)

  • Emergency medical coverage (minimum $50,000)

  • Coverage for the full value of the Tour plus estimated airfare

  • (Strongly Recommended) Cancel For Any Reason (CFAR) coverage — This type of policy provides the broadest cancellation protection available and may cover situations that standard policies exclude. However, CFAR policies vary by provider and may still contain exclusions for war, terrorism, or other specific events. 

⚠️ WARNING:

  • Most standard travel insurance policies EXCLUDE coverage for acts of war, terrorism, pandemics, and other Force Majeure events.

  • CFAR policies vary significantly. Some CFAR policies may also contain exclusions.

  • You must carefully read your policy terms and exclusions before purchasing.

  • If your policy does not cover your reason for cancellation, your claim may be DENIED and you will have no financial recourse.

 

Your travel insurance is your SOLE source of financial recovery if you cannot attend the Tour.

Proof of insurance is required within 14 days of signing your Tour Agreement. Failure to provide proof may result in cancellation of your reservation with no refund.

 

Sam Reynolds LLC dba Cafe Namaste does not provide, sell, recommend, or endorse any specific insurance provider. We cannot advise on policy selection or guarantee that any policy will cover your specific circumstances. It is your sole responsibility to research, evaluate, and purchase appropriate coverage.

8. FORCE MAJEURE

Cafe Namaste and its owners shall not be liable for any failure to perform obligations under this Agreement due to Force Majeure events.

If Cafe Namaste cancels or materially modifies a Tour due to Force Majeure:

  • We will provide written notice as soon as reasonably practicable

  • We may, at our sole discretion, offer credit toward a future tour, reschedule the Tour, or provide a partial refund minus non-recoverable costs

  • Any recovery is limited to amounts actually recovered from vendors

If you are unable to attend due to Force Majeure:

  • No refund will be issued

  • Your sole recourse is to file a claim with your travel insurance provider

  • We bear no financial responsibility for your inability to attend

9. HEALTH, WELLNESS & EMOTIONAL PREPAREDNESS

Physical & Mental Health:

  • You must be in good physical and mental health to participate.

  • You must disclose any medical conditions, allergies, medications, or mental health considerations that could affect your participation or the experience of others.

  • Consult your physician before travel to confirm fitness for international travel and planned activities.

  • You are solely responsible for obtaining all required vaccinations and health certificates and complying with the destination country's entry requirements.

Emotionally Intense Content: Some Tours include visits to sites of historical trauma, including but not limited to genocide memorials, mass grave sites, and museums depicting violence, death, and human suffering. Such experiences can be emotionally challenging and may trigger strong emotional responses, particularly for individuals with personal or ancestral connections to such events, or those with histories of trauma, anxiety, depression, or PTSD.

By booking, you:

  • Confirm you are emotionally prepared to engage with difficult historical content

  • Accept full responsibility for your emotional wellbeing during and after the Tour

  • Agree to communicate with us if you need to opt out of any portion of the itinerary

  • Release Cafe Namaste from any claims related to emotional distress, psychological impact, or mental health effects arising from exposure to such content

10. FITNESS REQUIREMENTS & RIGHT TO EXCLUDE

Our Tours are physically active and interactive. You must be in good physical condition to participate.

  • We reserve the right to request medical documentation confirming fitness to participate.

  • We reserve the right to exclude any participant whose fitness level, health condition, or behavior poses a risk to themselves or others — without refund.

  • If our Tour leader determines that a participant has misrepresented their fitness level or that their condition poses a safety hazard or negatively affects the group, we reserve the right to terminate their participation with no refund.

Cafe Namaste is not a medical or mental health provider and does not provide medical advice, diagnosis, or treatment. Tours are not a substitute for professional medical or psychological care.

11. TRAVEL DOCUMENTS (PASSPORT, VISA, VACCINATIONS)

You are solely responsible for:

  • Obtaining a valid passport (not expiring within 6 months of Tour end date)

  • Obtaining all required visas and entry permits

  • Complying with all vaccination and health requirements of the destination country

  • Understanding and complying with entry, exit, and transit requirements

We are not responsible for:

  • Denied boarding or entry due to missing or invalid documents

  • Costs, delays, or losses arising from your failure to obtain proper documentation

  • Providing legal advice on visa or immigration matters

If you are refused passage or entry due to documentation issues, no refund will be issued.

12. FLIGHTS & TRANSPORTATION

  • You are responsible for booking your own flights to and from the Tour destination.

  • A minimum number of participants is required for each Tour. Once you receive a FINAL CONFIRMATION EMAIL that the Tour is proceeding, you may book your flights.

  • Booking flights before receiving confirmation is entirely at your own risk.

  • We are not responsible for flight cancellations, delays, schedule changes, airline failures, missed connections, or any costs arising from travel disruptions.

  • We recommend purchasing flexible fare tickets and arriving at least 24 hours before the Tour start time.

13. ACCOMMODATIONS

  • Accommodations are provided through Third Party Suppliers and are subject to availability.

  • All accommodations are planned at reputable hotels selected for quality, safety, and proximity to key experiences.

  • We reserve the right to substitute accommodations of equal or higher standard if necessary due to unforeseen circumstances, operational changes, or acts beyond our control.

  • Prices are based on double occupancy unless otherwise noted. Single supplements are available for an additional fee.

  • For participants who wish to share a room, we will make best efforts to match you with a roommate. However, if a roommate cannot be found, you will be responsible for the single supplement cost. Notification will be provided by the date specified for each Tour.

  • Additional hotel charges (room service, minibar, laundry, etc.) are your responsibility.

14. TOUR MODIFICATIONS & SUBSTITUTIONS

We reserve the right to modify itineraries, accommodations, activities, or services due to circumstances beyond our control, including weather, local conditions, safety concerns, vendor availability, or operational requirements.

Such modifications do not entitle you to refunds or compensation, provided substitutions are of comparable value.

15. THIRD PARTY SUPPLIERS

Cafe Namaste works with Third Party Suppliers (hotels, airlines, local guides, transportation providers, activity operators, restaurants, etc.) to deliver Tour services. Third Party Suppliers may also engage the services of local operators and sub-contractors.

Although we take reasonable care in selecting Third Party Suppliers, we are unable to control Third Party Suppliers, do not supervise them, and cannot be responsible for their acts or omissions.

We are not liable for:

  • Acts, omissions, negligence, or failures of Third Party Suppliers

  • Flight cancellations, delays, or airline operational issues

  • Airline strikes, bankruptcies, or cessation of operations

  • Hotel overbookings, service failures, or property conditions

  • Ground transportation delays, accidents, or mechanical failures

  • Restaurant or food service issues, including food-borne illness

  • Activity provider negligence or equipment failures

  • Any other act or omission by any Third Party Supplier

Any services provided by Third Party Suppliers are subject to their own terms and conditions. Any claims arising from Third Party Supplier services must be pursued directly with the applicable Supplier.

16. ACTIVITIES & ASSUMPTION OF RISK

International travel and Tour activities involve inherent risks that cannot be eliminated, including but not limited to: illness, injury, death, crime, terrorism, political instability, natural disasters, transportation accidents, wildlife encounters, food-borne illness, exposure to infectious disease, and other hazards.

By booking, you:

  • Acknowledge and voluntarily assume all risks associated with the Tour

  • Release Cafe Namaste from liability for injury, illness, death, property damage, emotional distress, or other loss arising from participation

  • Agree to follow all safety instructions and use appropriate safety equipment

Some Tours may take you to remote areas or bring you into close contact with wildlife and other hazards. We cannot be held responsible in the event of an attack, accident, or encounter with any hazard.

Some activities may not be appropriate for all participants. We are not liable for incidents arising from your own lack of vigilance or failure to follow safety guidelines.

17. YOGA & WELLNESS WAIVER

Yoga, meditation, breathwork, and other wellness activities involve physical exertion and carry inherent risks, including but not limited to: muscle strains, sprains, fractures, falls, aggravation of pre-existing conditions, cardiovascular events, and other injuries.

By participating, you:

  • Disclose any physical limitations, injuries, or medical conditions to Owner and instructors before participating

  • Take full responsibility for your own participation and physical limits

  • Agree to modify or discontinue any activity if you experience discomfort, pain, dizziness, or other concerning symptoms

  • Consult with a physician before participating if you have any concerns about your ability to engage in physical activity

 

Cafe Namaste and wellness instructors are not medical professionals and do not provide medical advice, diagnosis, or treatment. Yoga and wellness activities are not substitutes for professional medical care.

You voluntarily assume all risks associated with yoga and wellness activities and release Cafe Namaste, instructors, and their agents from any liability for injuries sustained during such activities, except in cases of gross negligence or willful misconduct.

18. PURCHASES MADE DURING TOUR

Any purchases of goods or services made during the Tour from local vendors, markets, or other third parties are solely at your own risk.

We are not responsible for:

  • Defects in goods purchased

  • Shipping or delivery issues

  • Disputes with vendors

  • Quality or authenticity of items

This applies whether or not the vendor was recommended by Cafe Namaste, local guides, or any other person rendering Tour services.

19. PROPER CONDUCT REQUIRED

You must conduct yourself in a manner that is respectful to other participants, local communities, cultural sites, and Tour staff. You must obey the local laws and regulations of the places visited, including laws regarding drugs and alcohol.

We reserve the right to terminate participation and remove any participant whose conduct is:

  • Unsafe, disruptive, or inappropriate

  • Disrespectful to other participants, staff, local communities, or cultural sites

  • In violation of local laws or customs

  • Incompatible with the interests, safety, or welfare of the group

 

If removed, no refund will be issued and you are responsible for arranging and paying for all costs associated with early departure, including substitute travel and accommodations.

 

Cafe Namaste is not liable or responsible for any damages, costs, or expenses incurred as a result of your failure to obey local laws or conduct yourself appropriately.

20. PARTICIPANT COMPLAINTS

If you have a complaint during the Tour:

  1. Notify Cafe Namaste or your Tour leader immediately so we can attempt to resolve the issue.

  2. If unresolved during the Tour, submit your complaint in writing to hello@gocafenamaste.com within 30 days of the Tour end date.

We are not liable for complaints not brought to our attention during the Tour or not submitted in writing within 30 days.

21. USE OF IMAGES & TESTIMONIALS

By participating in a Tour, you grant Cafe Namaste permission to use photographs, video, audio recordings, and testimonials for promotional purposes, including print, online, and social media, without compensation.

You waive any right to inspect or approve finished materials.

To opt out: Notify us in writing at hello@gocafenamaste.com before the Tour begins. We will honor your request.

22. EMERGENCY COMMUNICATION

In the event of an emergency or disruption before or during the Tour, we will communicate via email and/or WhatsApp.

You are responsible for:

  • Ensuring we have your current contact information

  • Monitoring communications before and during the Tour

Failure to receive or respond to communications does not relieve you of any obligations under this Agreement.

23. LIMITATION OF LIABILITY

To the maximum extent permitted by law:

  • Cafe Namaste's total liability shall not exceed the amount you paid for the Tour.

  • We are not liable for any indirect, incidental, consequential, special, or punitive damages, including lost profits, lost time, emotional distress, loss of enjoyment, or other non-economic damages, regardless of whether we were advised of the possibility of such damages.

  • We are not liable for any injury, damage, death, loss, accident, or delay due to acts or omissions of Third Party Suppliers, government authorities, or Force Majeure events.

24. INDEMNIFICATION & RELEASE

You agree to:

  • Release Cafe Namaste and its successors from all claims, demands, losses, damages, rights, and actions of any kind, including personal injury, death, and property damage, that is directly or indirectly related to or arises from your participation in a Tour

  • Indemnify, defend, and hold harmless Cafe Namaste from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorney's fees) arising from your actions, negligence, or breach of this Agreement

 

This is a general release of all claims, whether known or unknown.

25. CLASS ACTION WAIVER

To the fullest extent permitted by law, you waive any right to participate in a class action lawsuit or class-wide arbitration against Cafe Namaste. Any disputes must be brought individually.

26. DISPUTE RESOLUTION & GOVERNING LAW

This Agreement is governed by the laws of the State of Florida, without regard to conflict of law principles.

Dispute Resolution Process:

  1. Any dispute shall first be submitted to mediation in Miami-Dade County, Florida, with costs shared equally by the parties.

  2. If mediation fails, any legal action shall be brought exclusively in the state or federal courts of Miami-Dade County, Florida.

  3. You consent to the personal jurisdiction of such courts.

In any legal action arising from this Agreement, the prevailing party shall be entitled to recover reasonable attorney's fees and costs from the non-prevailing party.

27. SEVERABILITY

If any provision of this Agreement is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.

28. TOUR AGREEMENT REQUIRED

All participants must sign a formal Tour Agreement and Release of Liability prior to departure.

The Tour Agreement contains additional terms and conditions. In the event of any conflict between these website Terms and the signed Tour Agreement, the Tour Agreement shall control.
